Service Description
Maryland Pest Control provides professional pest management and extermination services to residential and commercial properties throughout the State of Maryland. Our services include, but are not limited to, inspection and identification of pest infestations, implementation of integrated pest management programs, application of EPA-registered pesticides and rodenticides, installation of exclusion devices and traps, wildlife removal in accordance with Maryland Department of Natural Resources regulations, and ongoing monitoring and maintenance plans. Service specifics, including treatment frequency, covered pests, and service areas, are detailed in individual service agreements or work orders executed between Maryland Pest Control and the customer. All services are performed by licensed technicians in compliance with Maryland Department of Agriculture pesticide applicator licensing requirements and applicable federal, state, and local regulations. Weather conditions, property accessibility, pest biology, and environmental factors may affect service delivery and outcomes.

MARYLAND PEST CONTROL MAKES NO EXPRESS OR IMPLIED GUARANTEES OR WARRANTIES REGARDING THE COMPLETE ELIMINATION OF PESTS OR THE PERMANENT PREVENTION OF FUTURE INFESTATIONS. Pest control results vary based on numerous factors outside our reasonable control, including but not limited to pest species, infestation severity, structural conditions of the property, neighboring infestations, climate patterns, and customer compliance with recommended sanitation and exclusion measures. Any testimonials or descriptions of results on our website or marketing materials represent individual experiences and do not constitute guarantees of similar outcomes. We do not warrant that our services will meet your specific expectations or that pest activity will not recur after treatment. Our obligation is to perform services in a professional, workmanlike manner consistent with industry standards. Customers acknowledge that complete pest eradication may require multiple treatments and continued cooperation.
User Responsibilities
Customers must provide accurate and complete information regarding property conditions, known pest activity, prior treatments, chemical sensitivities of occupants, and presence of children, elderly individuals, or pets. You must prepare the property as instructed prior to service, which may include removing food items, covering fish tanks, securing pets, and ensuring technician access to treatment areas. Customers are responsible for maintaining proper sanitation, eliminating standing water, sealing food in appropriate containers, and implementing structural repairs and exclusion measures recommended by our technicians. Failure to fulfill these responsibilities may significantly diminish treatment effectiveness and may void any service commitments. You must notify us immediately of any adverse reactions, property damage concerns, or persistent pest activity following treatment. Customers grant Maryland Pest Control and our technicians safe access to the property during scheduled appointment windows. Repeated cancellations, failure to provide access, or hostile conduct may result in service termination without refund.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARYLAND PEST CONTROL'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, PROPERTY DAMAGE BEYOND THE COST OF REMEDIATION, PERSONAL INJURY EXCEPT AS REQUIRED BY LAW, OR EMOTIONAL DISTRESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation applies regardless of whether the claim is based on contract, tort, strict liability, negligence, or any other legal theory. We are not liable for damage to personal property, landscaping, or structural elements unless directly caused by our gross negligence and documented within forty-eight hours of service. Our liability for damage to real property is limited to the cost of repair or replacement of the damaged portion only.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade dress, photographs, videos, written content, service descriptions, and proprietary methodologies displayed on our website, marketing materials, or utilized in service delivery are the exclusive intellectual property of Maryland Pest Control or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Customers receive no ownership interest in any intellectual property through service engagement. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our intellectual property without prior written consent. Unauthorized use of our trademarks or service marks constitutes infringement and may result in legal action. Any feedback, suggestions, or ideas provided to Maryland Pest Control may be used without restriction or compensation.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in Maryland, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction or venue on the grounds of inconvenient forum. These Terms are subject to all applicable federal laws and Maryland state regulations governing pest control services, pesticide application, and consumer protection, including oversight by the Maryland Department of Agriculture and the Maryland Attorney General's Consumer Protection Division.
Changes to Terms
Maryland Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason in our sole discretion. Changes become effective immediately upon posting to our website or other written notification to customers. Material changes affecting existing service agreements will be communicated with at least thirty days' advance notice where practicable. Your continued use of our services following any changes constitutes binding acceptance of the revised terms. We encourage you to review these Terms periodically. The most current version will be indicated by the "Last updated" date at the top of this document. If you do not agree to modified terms, you must discontinue services and notify us in writing prior to the effective date of changes.
